The materials contained on our site are provided for general information purposes only and do not claim to be or constitute legal or other professional advice and shall not be relied upon as such.

We do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent permitted by English Law, we exclude all liability for loss or damages direct or indirect arising from the use of this site.

Accessing Our Site: Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

Products & Packaging: The images of the products on our website are for illustrative purposes only. The packaging of the product may vary from that shown in images on our website on occasion. Images may not be used without consent from  Candle Magic Boutique in advance. All products are subject to availability and whilst we endeavor to keep good stock levels at all times, we regret we cannot always guarantee to have all products in stock.  We will inform you of any items that are unavailable as soon as we possibly can to avoid disappointment.

Order Amendments: If the Customer wishes to make a change to the product has ordered please contact us. We will confirm if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of supply, or anything else which would be necessary as a result of the requested change and ask you to confirm whether you wish to go ahead with the change. We may change the product to reflect changes in relevant laws and regulatory requirements.

Incorrect orders/Goods not received/Breakages: Should any of the goods supplied arrive damaged, or do not meet the requirements stated on your original order, Candles Magic Boutique shall have no liability unless you notify us of the issue within 48 hours of receiving the goods.  All items that have been damaged through transit, can be refused a point of delivery or should be kept by you until you have notified us and supplied sufficient photographic evidence of said damage. In turn, we will offer you a full refund.

Our Liability: If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen.

Credit card details are not retained. The only information stored in a customer’s transaction is history, name, address & e-mail address.

Breaches of these terms of use: Without prejudice to our other rights under these terms of use, if you breach these terms of use in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Acceptable Use: You must not use our website in any way that causes or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. Restricted Access: Access to certain areas of our website is restricted. We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion. If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password are kept confidential. We may disable your user ID and password at our sole discretion without notice or explanation.

Indemnity: You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities, and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of any breach by you of any provision of these terms of use, or arising out of any claim that you have breached any provision of these terms of use.

Variation: We may revise these terms of use from time to time. Revised terms of use will apply to the use of our website from the date of the publication of the revised terms of use on our website. If the need arises, we may suspend access to our site, or close it indefinitely. Please check this page regularly to ensure you are familiar with the current version. We aim to update our site regularly and may change the content at any time.

Payment: Online payments are made in a secure environment. Payments must be made in sterling and by one of the following credit card payment methods – Paypal, Visa, MasterCard, American Express, Switch, Solo, Delta, and Electron.

Delivery: We will deliver the products to you as soon as reasonably possible and in any event within 30 days after the day on which we accept your order if you are a consumer. If our supply of the products is delayed by an event outside our control, then we will contact you as soon as possible and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay, you may contact us to end the contract and receive a refund for any products you have paid for but not received. Our goods are available for delivery to the UK mainland only through our website. Please contact us to organize the delivery of goods to other locations.

International Shipping: We ship all our products via Royal Mail Post. All international orders are sent out using International Tracked shipping, which allows you the customer to track every stage of the delivery process. Once your order has been shipped out, you should then receive your personal tracking number which will be sent to the email address provided at the checkout. All International Signed orders will not be supplied with a tracking - you will however be notified once your order has been shipped out. At the end of the shipping process, you will be required to sign for the order to complete the delivery process.

We offer free UK & International Shipping on all orders over £150 

 

The risk in the goods will pass to the Customer on delivery. Usage notes for all our candles are included with the delivery of goods.

Cancellations & Returns: If you are a consumer then for most products bought online you have a legal right to change your mind within 14 days and receive a refund under the Consumer Contracts Regulations 2013. Items can only be returned for a refund if they are unopened, unused, and in a re-saleable condition with all tamper-resistant seals, packaging, and any packaging intact. Please ensure you obtain proof of postage when returning item(s).

If you require a refund we will refund the price paid by you for the products (minus the initial standard delivery charge within fourteen (14) days of receiving your returned products, provided that you have returned the products to us within 14 working days of delivery to you notifying us of cancellation.

Exclusion of third-party rights These terms of use are for the benefit of you and us and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in relation to these terms of use is not subject to the consent of any third party.

Entire agreement These terms of use together with our privacy policy constitute the entire agreement between you and us in relation to your use of our website and supersede all previous agreements in respect of your use of this website.
